Privacy statement VOF MaatwerkWeb

VOF MaatwerkWeb (hereinafter: “MaatwerkWeb”, “we” or “us”), established in Oude-Tonge (the Netherlands) and registered with the Dutch Chamber of Commerce under number 42000187, is the controller for the processing of personal data as set out in this privacy statement. Below we explain which personal data we collect, for what purpose we do so, how we protect that data and what your rights are under the General Data Protection Regulation (GDPR).

Which personal data do we process?

MaatwerkWeb processes your personal data because you use our services, visit our website, and/or because you provide this data to us yourself (for example via a quote request or by email).

We process the following data, among others:

Identification and contact details: first and last name, address details, phone number, email address.

Company details (B2B): company name, Chamber of Commerce number, VAT number, job title of the contact person.

Financial details: bank account number (IBAN) and account holder name for invoicing and payments.

Technical and interaction data: IP address, browser data, login details for client environments/hosting, data about your activities on our website.

For what purpose and on what legal basis do we process data?

We process your personal data solely for specific, explicitly described purposes and on the basis of a legal ground:

Performance of the agreement: to deliver our services (such as developing websites, software, custom solutions, hosting and maintenance), to issue quotes and to stay in contact with you.

Invoicing and administration: for the financial handling of our services.

Legal obligation: to comply with legal obligations, such as our fiscal retention duty towards the Dutch tax authorities.

Legitimate interest: to secure, optimise and improve our systems and services, as well as for business communication.

AI and data protection (AI privacy safeguard)

In line with article 7.2 of our Terms and Conditions, we apply strict principles regarding Artificial Intelligence (AI) and data minimisation:

No public training: we guarantee that no directly identifiable personal data or trade secrets are entered into public AI models.

Shielded environments: data input for the development or optimisation of software/content only takes place in anonymised form or within shielded (Enterprise) AI environments. These environments contractually exclude the use of submitted data for training public or commercial AI models.

Retention periods

MaatwerkWeb does not retain your personal data for longer than is strictly necessary to achieve the purposes for which the data is collected:

Administrative and fiscal data: 7 years (in accordance with the statutory fiscal retention duty).

Client and project data: for the duration of the agreement and up to a maximum of 2 years after it ends, unless longer retention periods are necessary for legal settlement or warranty claims.

Quotes (not accepted): a maximum of 60 days after the validity date has expired.

Sharing personal data with third parties

MaatwerkWeb never sells your data to third parties. We only provide your data to third parties where this is necessary to perform our agreement with you or to comply with a legal obligation.

This may include: hosting and server providers; domain name registrars; software and licence suppliers (auxiliary staff/external specialists in accordance with art. 6.1 of our terms); our accountant or bookkeeping firm for the financial administration.

With companies that process your data on our instructions (processors) we conclude a data processing agreement, to ensure the same level of security and confidentiality of your data.

Security of personal data

We take the protection of your data seriously and apply appropriate technical and organisational measures to prevent misuse, loss, unauthorised access, unwanted disclosure and unauthorised modification. This includes, among other things:

Secured network connections (SSL/TLS encryption on websites and systems).

Strict access restrictions to project files and databases.

Regular security and software updates.

Your rights (rights of the data subject)

You have the right to access, rectify or erase your personal data. In addition, you have the following rights:

Right to restriction: the right to have the processing of your data temporarily suspended.

Right to object: the right to object to the processing of your personal data.

Right to data portability: the right to receive your data in a structured, commonly used and machine-readable format in order to transfer it to another organisation (see also art. 11 and 15 of our terms).

Withdrawing consent: insofar as the processing is based on your consent, you have the right to withdraw it at any time.
